Welcome to Casino World. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "Player", "you") and Casino World ("Company", "we", "us", or "our") governing your access to and use of the Casino World website located at https://us-casinoworld.com/, our mobile applications, and any related games, content, features, and services we offer (collectively, the "Services" or "Game").

By registering an account, downloading our application, accessing the website, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you are strictly prohibited from using the Services and must discontinue use immediately.

1. Eligibility and Acceptance

1.1 Age Restrictions

The Services are intended solely for users who are eighteen (18) years of age or older, or the age of legal majority in your jurisdiction of residence, whichever is older. By accessing or using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract. We do not knowingly collect information from or permit individuals under the age of 18 to play our games. We reserve the right to request proof of age at any stage to verify that minors are not using the Service.

1.2 Jurisdictional Compliance

You are solely responsible for ensuring that your use of the Services complies with all applicable local, state, national, and international laws, rules, and regulations in your jurisdiction. The availability of the Services does not constitute an offer, solicitation, or invitation by us for the use of the Services in any jurisdiction in which such activities are prohibited by law.

1.3 Entertainment Purposes Only

Casino World is a social casino platform designed strictly for amusement and entertainment purposes. WE DO NOT OFFER REAL MONEY GAMBLING. The games do not provide an opportunity to win real money, physical prizes, or anything of tangible, real-world value based on gameplay. Any reference to "coins," "gems," "winnings," "jackpots," or "payouts" refers solely to virtual, in-game currency that has no monetary value outside of the Casino World ecosystem. Practice or success at our social casino games does not imply or guarantee future success at real money gambling.

2. User Accounts

2.1 Account Creation

To access certain features of the Game, you must register and create an account ("Account"). You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You may not use a username that is offensive, vulgar, infringes on the intellectual property rights of others, or impersonates another person or entity.

2.2 Account Security

You are solely responsible for safeguarding your password and for all activity that occurs under your Account, whether or not you have authorized such activities. You agree to notify us immediately of any unauthorized use of your Account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your login credentials.

2.3 Account Limitations

You may only maintain one (1) Account per person. Creating multiple accounts to exploit daily bonuses, manipulate leaderboards, or circumvent bans is strictly prohibited and will result in the immediate termination of all associated accounts. You may not purchase, sell, gift, or trade any Account, or offer to purchase, sell, gift, or trade any Account, and any such attempt shall be null and void.

3. Virtual Currency and In-App Purchases

3.1 Virtual Goods

The Services may include virtual, in-game currency (such as "Coins" and "Gems") and virtual items (such as "Charms", avatars, and buildings) (collectively, "Virtual Goods"). Virtual Goods may be earned through gameplay, awarded as bonuses, or purchased using real money.

3.2 License to Virtual Goods

You understand and agree that you do not own Virtual Goods. Regardless of how they are acquired, Virtual Goods have no real-world cash value and can never be exchanged, cashed out, or redeemed for real money, goods, or services from us or any other party. When you obtain Virtual Goods, you are receiving a limited, personal, non-transferable, non-sublicensable, revocable license to use those Virtual Goods strictly within the Services for personal, non-commercial entertainment purposes.

3.3 Purchases and Payments

All purchases of Virtual Goods are processed through third-party payment providers (e.g., Apple App Store, Google Play Store, credit card processors). You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. We may revise the pricing for Virtual Goods at any time without notice.

3.4 Final Sales and No Refunds

ALL SALES OF VIRTUAL GOODS ARE FINAL AND NON-REFUNDABLE. We are not required to provide a refund for any reason, and you will not receive money or other compensation for unused Virtual Goods when an account is closed, whether such closure was voluntary or involuntary. The only exceptions are where refunds are mandated by applicable statutory law.

3.5 Management of Virtual Goods

We retain the absolute right to manage, regulate, control, modify, and/or eliminate Virtual Goods as we see fit in our sole discretion, and we shall have no liability to you or anyone for the exercise of such rights. In the event of an account termination or suspension, all Virtual Goods associated with that account will be immediately forfeited.

4. User Conduct and Rules of Play

To ensure a safe, fair, and enjoyable environment for all players, you agree to adhere to the following rules of conduct. You agree that you will NOT, under any circumstances:

• Cheat or Exploit: Use hacks, cheats, automation software (bots), macros, or any unauthorized third-party software designed to modify the Casino World experience, manipulate game outcomes, or farm Virtual Goods.
• Harass or Abuse: Engage in conduct that is abusive, harassing, toxic, threatening, or bullying towards other players or Casino World staff in chat rooms, party rooms, or private messages.
• Post Offensive Content: Transmit or communicate any content that is offensive, unlawful, defamatory, obscene, sexually explicit, racially or ethnically objectionable, or otherwise inappropriate.
• Spam or Scam: Spam the chat channels, advertise commercial products or services, attempt to phish for user credentials, or promote "free coin" scams.
• Violate Intellectual Property: Upload or transmit any material that infringes upon the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party.
• Interfere with Services: Attempt to interfere with, hack into, or decipher any transmissions to or from the servers running the Services, or launch Denial of Service (DoS) attacks.
• Exploit Bugs: Exploit any bug, glitch, or game mechanic flaw for personal gain. If you discover a bug, you must report it to customer support immediately.

We reserve the right to monitor communications and gameplay. Any violation of these rules may result in temporary suspension, permanent account termination, forfeiture of all Virtual Goods, and potentially legal action.

5. Intellectual Property Rights

5.1 Our Ownership

All content included in the Services, including but not limited to text, graphics, logos, images, audio clips, video clips, game mechanics, software, source code, visual interfaces, interactive features, and the selection and arrangement thereof (collectively, "Company Content"), is the exclusive property of Casino World or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

The "Casino World" name, logos, and all related product and service names, design marks, and slogans are the trademarks or service marks of Casino World. You may not use these marks without our prior written permission.

5.2 User Content

The Services may allow you to create, upload, or post content, such as chat messages, profile text, or custom room designs ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

You represent and warrant that you own or have the necessary rights to post your User Content and that it does not violate these Terms or the rights of any third party.

6. Modification, Suspension, and Termination

6.1 By Casino World

We reserve the right to suspend, disable, or terminate your Account and your access to the Services at any time, for any reason, with or without notice, at our sole discretion. Common reasons for termination include, but are not limited to, suspected violations of these Terms, illegal activity, account inactivity for an extended period, or upon request by law enforcement. Upon termination, your right to use the Services and any Virtual Goods will immediately cease.

6.2 By You

You may terminate your Account at any time by contacting customer support. If you choose to terminate your account, you will forfeit any remaining Virtual Goods.

6.3 Changes to the Services

We are constantly evolving and improving Casino World. We reserve the right to modify, update, suspend, or discontinue the Services, or any part thereof (including specific games, features, or the availability of the platform), at any time, with or without notice. We will not be liable to you or any third party for any modification or discontinuation of the Services.

7. Disclaimers of Warranties

THE SERVICES, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIALS, AND INFORMATION MADE AVAILABLE ON OR ACCESSED THROUGH THE SERVICES, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, CASINO WORLD MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER REGARDING THE SERVICES.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR FROM A COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS. YOU ASSUME ALL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SERVICES AND YOUR RELIANCE THEREON.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CASINO WORLD, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, INCLUDING NEGLIGENCE, OR OTHERWISE) EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO CASINO WORLD IN THE ONE HUNDRED EIGHTY (180) DAYS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT ANY SUCH CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless Casino World, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to:

1. Your access to or use of the Services;
2. Your violation of any term of these Terms of Service;
3. Your violation of any third-party right, including without limitation any intellectual property, confidentiality, property, or privacy right;
4. Your User Content; or
5. Any conduct or content of any third party on the Services.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

10. Dispute Resolution, Binding Arbitration, and Class Action Waiver

10.1 Initial Dispute Resolution

We are available by email to address any concerns you may have regarding your use of the Services. Most concerns can be quickly resolved in this manner. You agree to use best efforts to settle any dispute, claim, question, or disagreement directly through consultation and good faith negotiations with Casino World customer support before initiating any lawsuit or arbitration.

10.2 Binding Arbitration

If we cannot resolve the dispute informally, you and Casino World agree that any controversy or claim arising out of or relating to these Terms, the Services, or your relationship with us shall be finally resolved by binding arbitration, rather than in court. The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and Mediation Procedures. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

10.3 Class Action Waiver

YOU AND CASINO WORLD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

10.4 Exceptions

Notwithstanding the foregoing, either party may bring an individual action in small claims court. Furthermore, either party may seek emergency equitable relief (such as an injunction) before the state or federal courts located in the jurisdiction where Casino World is headquartered to maintain the status quo pending arbitration, or to stop unauthorized use or abuse of the Services or intellectual property infringement.

11. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. For any disputes not subject to the arbitration provision above, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Delaware.

12. General Provisions

12.1 Entire Agreement

These Terms, along with the Privacy Policy, constitute the entire agreement between you and Casino World regarding your use of the Services, superseding any prior agreements or understandings between you and us.

12.2 Severability

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

12.3 Waiver

The failure of Casino World to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver will be effective only if in writing and signed by an authorized representative of Casino World.

12.4 Assignment

You may not assign or transfer these Terms or your Account without our prior written consent. We may freely assign these Terms or delegate our obligations without restriction.

12.5 Force Majeure

Casino World shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

13. Changes to These Terms

We reserve the right to amend these Terms of Service at any time. If we make material changes, we will notify you by revising the "Last Updated" date at the top of this document, and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you a notification within the app). Your continued use of the Services following the posting of changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms regularly.
